This privacy policy pertains to the use of all services related to Background Station, LLC and the web site at www.BackgroundStation.com. By this web site you are agreeing to be bound by the following terms and conditions ("Terms of Service").

Background Station reserves the right to modify or terminate your Background Station service for any reason, without notice at any time. We reserve the right to refuse service to anyone for any reason at any time. We may, but have no obligation to, remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.

We reserve the right to alter these Terms of Use at any time.

1. You must be 13 years and older to use this site.
2. You are responsible for any activity that occurs under your screen name.
3. You are responsible for keeping your password secure.
4. You must not abuse, harass, threaten or intimidate other users.
5. You may not use any Background Station service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
6. You are solely responsible for your conduct and any data, text, clips, comments, information, screennames, graphics, photos, profiles, audio and video clips, links("content")that you submit, post, and display on the Background Station service.
7. You must not modify, disrupt, adapt or hack Background Station or modify another website so as to falsely imply that it is associated with Background Station.
8. You must not attempt to interfere with or hack into any user accounts.
9. You must not to reproduce, duplicate, copy, sell, resell or exploit any portion of the content, other member's information, or the service provided by Background Station.
10. You must not upload, post or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.
11. You must not create or submit unsolicited or unauthorized email to any Background Station members ("spam").
12. You must not transmit any worms or viruses or any code of a destructive nature.
13. You must not, in the use of Background Station, violate any laws in your jurisdiction (including but not limited to copyright laws).

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials, whether publicly posted or privately transmitted, are the sole responsibility of the person from which such content originated. Background Station does not control content posted via the Service and, as such, does not guarantee the validity of such content. You also understand that by using the Service, you may be exposed to content that is offensive, indecent or objectionable. While Background Station prohibits such conduct and content on its site, you understand and agree that Background Station cannot be responsible for the content posted on its web site and you nonetheless may be exposed to such materials and that you use the Background Station service at your own risk. Any material downloaded or otherwise obtained through the use of the website is done at your own discretion and risk and you will be solely responsible for any damages to your computer system or loss of data that results from the download of such material.

• You can remove your profile at any time by deleting your account, but content that you upload may remain on the Background Station service.
• You grant to Background Station and its designees a perpetual, irrevocable, non-exclusive and royalty free license to use any ideas, expression of ideas or other materials you submit (collectively, "materials") to Background Station without restrictions of any kind and without any payment or other consideration of any kind, or permission or notification, to you or any third party. The license shall include, without limitation, the irrevocable right to reproduce, prepare derivative works, combine with other works, alter, translate, distribute copies, display, perform, license the materials, and all rights therein, in the name of Background Station, or its designees throughout the world in perpetuity in all forms of media.
• You agree that the materials you submit do not and will not violate the rights of any third party or any local, state, national or foreign law, including any right of publicity, right of privacy or any other proprietary right.
• Background Station undertakes to obey all relevant copyright laws. We will review all claims of copyright infringement received and remove content deemed to have been posted or distributed in violation of any such laws. To make a claim, please provide us with the following:
  • A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
  • A description of the copyrighted work claimed to have been infringed;
  • A description of the infringing material and information reasonably sufficient to permit Background Station to locate the material;
  • Your contact information, including your address, telephone number, and email;
  • A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  • A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.
